Google's 'first-class' Nexus 7 tablet: 4 takeaways

The Nexus 7, which is built by Asus under Google's supervision, will run the newest version of Android, 4.1 Jelly Bean, and comes with a 1280 x 800 back-lit display, an Nvidia quad-core Tegra 3 processor, and 1 GB of of RAM. When you look at the other available products in the same price range ? Amazon's Kindle Fire, Samsung's Galaxy Tab 2 7.0 ? "everything else basically looks like crap," says JR Raphael at Computerworld. But "this thing provides a first-class tablet experience at a budget level price."?

2. The Nexus 7's quality is readily apparent
"The tablet looks and feels sturdy," says Sara Yin at PC Mag. Its lighter and more powerful than the Fire, and its "rounded, tapered edges" with a rubber matte backing give it a distinctly "sporty" feel. A Google UI designer says Jelly Bean was designed with a 7-inch display in mind, and the difference is noticeable: "The tablet performs pretty flawlessly and scrolling is buttery smooth."?

3. The tablet takes advantage of Google's strengths
I think the OS improvements are merely incremental, says Dan Gillmor at the Guardian, "but they are impressive and keep Google at least [on par] with Apple's iOS in most ways, and ahead in a few." What really makes this particular Android device "truly compelling" is the resources of Google itself: Search, maps, and more, which are all a close approximation of their more robust desktop versions. Jelly Bean's ability to do so underscores why these Nexus devices are so important: They give users "the absolute latest operating systems on excellent hardware ? and Google, not a carrier, keeps them updated."

4. It's going international
Believe it or not, $199 isn't the Nexus 7's most important price point, says Vlad Savov at The Verge: It's ?159. The Nexus 7 will go on sale in? the U.K. (and Australia and Canada) ? places where it's been difficult for Amazon to eke out content deals for things like Netflix movies (which were only recently added) or U.S.-only services like Turntable.fm, which severely limits the Kindle Fire's appeal abroad. "In beating Amazon to a broader international rollout with its media tablet, Google is laying an essentially uncontested claim to three important English-speaking markets." That's the Nexus 7's real trump card.

Laura W. Murphy: 'Fixing' Citizens United Will Break the Constitution

In ?Fixing Citizens United,? Professor Geoffrey Stone -- usually a friend to the First Amendment -- argues for a constitutional amendment to ?fix? the Citizens United Supreme Court decision.?Professor Stone mentions the proposal rather offhandedly, but the idea is a nuclear option.?A constitutional amendment -- specifically an amendment limiting the right to political speech -- would fundamentally ?break? the Constitution and endanger civil rights and civil liberties for generations.

First, it?s important to be clear on what Citizens United did.?The case allowed corporations and unions (including non-profit corporations like the ACLU or National Rifle Association) to spend ?general treasury? (non-political action committee) funds on political communications that are not coordinated with a campaign.?Citizens United itself has very little to do with the dreaded ?Super PACs,? which are primarily funded by individual donations.?Individuals have been allowed to spend their own money on political speech since time immemorial (or at least since adoption of the First Amendment).?Further, Citizens United has nothing to do with direct contributions to candidates, which are still totally verboten for corporations and unions and strictly limited for individuals.

With that background, here?s the proposed amendment.

In order to ensure a fair and well-functioning electoral process, Congress and the States shall have the authority reasonably to regulate political expenditures and contributions.

When Professor Stone says federal and state governments ?shall have the power to regulate political expenditures,? he means to give them the ability to place limits on, and control the content of, political speech, even when it is non-partisan and independent of a campaign.?This speech would include typical ?vote for X? ads, but would also extend to political ?issue? advertisements (?call Senator Reid and tell him to support bill Y?), documentaries by Michael Moore and other political filmmakers and probably even social media platforms like Twitter or Facebook.?The problems with such an approach are many.

The Constitution?s radical stability is its greatest strength.?The high bar for amending the Constitution -- agreement by two-thirds of both the Senate and the House (or the states), and then three-fourths of state legislatures or constitutional conventions -- exists precisely to deter ill-considered but temporarily popular amendments, which I would argue this is.?People are wary to invest resources and time in promoting or championing constitutional amendments because the chances of failure are high.?That?s why our Constitution works so well.?It?s easy to interpret broadly, but textual change requires effort and sustained support.?

Clearly cognizant of this particular concern, Professor Stone suggests that his amendment would not be unprecedented.?On the contrary, while not the first amendment responsive to a Supreme Court case, this would be the first amendment in history to limit individual, constitutionally guaranteed rights.?The four amendments he mentions as precedent all either clarified the scope of existing constitutional provisions or expanded individual rights.?For the curious, I believe the amendments he is referring to are the 11th (states can?t be sued by people in federal court), 14th (expanding equal protection and due process rights in the wake of the Civil War), 16th (federal income tax not unconstitutional) and 26th (voting age no higher than 18).

Further, although success of an amendment limiting individual rights is thankfully unprecedented, proposed amendments certainly are not.?

The ACLU has been on the (often lonely) frontline against ill-considered but temporarily popular constitutional amendments to limit civil liberties since its inception.?For 20-plus years, we?ve been fighting amendments prompted by Supreme Court decisions in United States v. Eichman and Texas v. Johnson, which held unconstitutional state and federal laws banning flag desecration.?We?ve repeatedly opposed the ?Victims? Rights Amendment,? which would unfairly limit certain due process rights, including the right to a fair trial.?And (this is the best), Republicans today are calling for an amendment repealing the 14th Amendment?s guarantee of citizenship if you are born in the United States.?Some grotesquely call it the ?anchor baby? amendment.

Now imagine a world where Stone?s proposed Citizens United amendment serves as real precedent for using the amendment process to limit rights, and both houses of Congress are two-thirds Republican (the latter is not inconceivable even in the next Congress).?Flag desecration, victims? rights and birthright citizenship amendments would just be the beginning.?Undoubtedly, you would see additional attempts to limit individual rights through the amendment process simply on the strength of the argument:?well, we did it with political speech, why not with pornography, affirmative action, voting requirements, warrantless national security surveillance or any other similarly hot-button issue??You can bet a successful Citizens United amendment would be talking point number one for groups pushing an amendment to overturn Roe v. Wade.

Reasonable minds can and should differ on the influence of ?big money? in politics.?The legal and policy questions raised by the link between concentrated wealth and political speech are numerous and complicated.?We should be discussing the health of our politics, and we should be doing more to, for instance, provide for public financing and promote transparency without quelling anonymous speech.?But if there is one thing we absolutely should not be doing, it?s tinkering with our founding document to prevent groups like the ACLU (or even billionaires like Sheldon Adelson) from speaking freely about the central issues in our democracy.?Doing so will fatally undermine the First Amendment, diminish the deterrent factor of a durable Constitution and give comfort to those who would use the amendment process to limit basic civil liberties and rights.?It will literally ?break? the Constitution.

LOS ANGELES (AP) ? Before Nancy Meyers, before Sofia Coppola, before Julie Delpy and Kasi Lemmons and Nicole Holofcener, there was Nora Ephron.

She was a rare woman writing and directing in what was (and still is) the male-dominated industry of filmmaking. Ephron staked out her spot on the cinematic landscape with a distinctive voice and formidable wit. Now, she leaves behind a legacy of classic moments and quotable lines after succumbing to leukemia Tuesday at age 71.

The very mention of her name calls to mind a certain kind of movie, something you can't say about many filmmakers, regardless of their gender. They were romantic comedies, yes, but ones for smart women, about smart women, with characters who had both bite and vulnerability to them. Maybe they were a tad too hyper-analytical or neurotic, but they were always highly verbal and, more often than not, destined for the kind of happy ending they deserved.

Meg Ryan forged and reinforced her status as America's Sweetheart with roles in movies Ephron either wrote or wrote and directed: The best of these was 1989's "When Harry Met Sally ..." (directed by Rob Reiner), followed by "Sleepless in Seattle" in 1993 and "You've Got Mail" in 1998, both with Tom Hanks in winning form as Ryan's likable everyman co-star.

Decades later, you can still say the line, "I'll have what she's having," and everyone will instantly know what you're talking about. That's how lasting Ephron's work has been and will remain.

Back in the late '80s and early '90s, Kathryn Bigelow was a rare fellow female filmmaker ? and since has gone on to become the only woman to win an Academy Award for best director, for "The Hurt Locker" ? but she's focused on action pictures. Barbra Streisand also tried her hand at directing around this time with "Yentl," ''The Prince of Tides" and "The Mirror Has Two Faces." But Ephron continued on and endured, for better and for worse.

If we're being honest, some of her later work didn't come close to the level of her best-known and best-loved films. "Hanging Up" from 2000, which she and sister Delia co-wrote and star Diane Keaton directed, felt shrill and slapsticky. "Bewitched" (2005), a big-screen version of the 1960s sitcom which she directed, wrote and produced, seemed like a gimmicky strain.

But her final film, 2009's "Julie & Julia," ended her career on a stronger note. Ephron directed Meryl Streep to one of her 17 Academy Award nominations for her joyous, pitch-perfect portrayal of pioneering chef Julia Child. And it was Streep who would play a version of Ephron herself in one of the earliest films she wrote, 1986's "Heartburn," based on her own scathing novel inspired by her marriage to Washington Post reporter Carl Bernstein.

Ephron was a three-time Oscar nominee for the screenplays she wrote or co-wrote for "When Harry Met Sally ..." and "Sleepless in Seattle" as well as for her first produced script, for 1983's "Silkwood," directed by friend and frequent collaborator Mike Nichols and again starring Streep in the real-life nuclear drama.

Looking back on the A-list names listed in this piece, it's a real testament to her talent that high-quality actors and filmmakers were drawn to her and wanted to be associated with her again and again. And we haven't even mentioned Billy Crystal, Carrie Fisher, Jack Nicholson, John Travolta, Steve Martin, the list goes on.

It's that kind of singularity of voice and vision that sets an example for filmmakers to come ? both male and female.

RUB researcher and Japanese colleagues report in the Journal of Biological Chemistry

How single cell organisms like bacteria manage to react to their environment is not yet completely understood. Together with colleagues from Japan, Dr. Samir El-Mashtoly from the RUB Department of Biophysics, led by Prof. Dr. Klaus Gerwert, has gained new insights into the molecular interactions during aerotaxis of Bacillus subtilis, i.e., the dependence of the movement direction on the oxygen concentration in the environment. The research team investigated the conformational changes within the protein HemAT. Via a signal transduction chain, this protein sends a command to the flagellar motor which controls the movement direction. They report in the Journal of Biological Chemistry.

Signal transduction chain

The signal transduction chain starts with binding of oxygen to HemAT's heme domain, which is also known from haemoglobin in the red blood cells and is called the sensor domain of HemAT. Oxygen binding leads to a conformational change in the sensor domain. This in turn provokes several further conformational changes within HemAT that finally affect the signalling domain of the protein. The signalling domain then transmits the information about a rise in oxygen concentration to other proteins within the cell. These proteins forward the message to the motor of the flagellum. The research team investigated how the information travels from the sensor domain of HemAT to its signalling domain.

Protein helices forward the information

For that purpose, Dr. El-Mashtoly used the time-resolved ultraviolet resonance Raman spectroscopic facilities in the Picobiology Institute in Japan. This method provides, for instance, structural information about the conformation of the protein and hydrogen bonding interactions on a nanosecond to microsecond time scale. The results suggest that the conformational change in the sensor domain, i.e., the heme structure, induces the displacement of two protein helices within HemAT. This displacement affects another helix which is continuous with the structure of the signalling domain. Due to a series of conformational changes, the information about oxygen binding thus reaches the signalling domain of the protein.

(AP) ? A newly sworn-in congressman who was injured in a mass shooting last year along with then-Rep. Gabrielle Giffords held his first "Congress on Your Corner" event with southern Arizona constituents on Saturday.

Giffords conducted 21 of the informal meet-and-greet events during her more than four years in office, including one on the day of the shooting ? Jan. 8, 2011. The rampage left six dead and 13 wounded, including Giffords and her then-district director, Ron Barber.

Giffords relinquished the seat in January to concentrate on her recovery from a gunshot wound to the head. Barber, a Democrat, won a special election to replace her earlier this month. He was sworn in Tuesday in Washington, D.C.

About 300 people showed up at Saturday's event outside a Tucson grocery store as temperatures topped 100 degrees, Barber spokesman Mark Kimble said. Visitors ranged from other survivors of the mass shooting and well-wishers to people who had concerns about their federal student loans or veteran's benefits, he said.

The event had been scheduled to last an hour and a half.

"But there were so many people, we went three hours," Kimble said.

Jared Lee Loughner has pleaded not guilty to 49 charges stemming from the shooting, which took place in front of another Tucson grocery store.

Barber was shot twice ? once in the face and once in the leg. He was asked by Giffords earlier this year to pursue the seat, and she appeared in Tucson during the campaign's final days to help him.

Barber defeated Republican Jesse Kelly, who narrowly lost to Giffords in 2010.

Consumer bureau discloses credit-card complaints - eShareholder

(Reuters) - Consumers shopping for a credit card can see for the first time, starting on Tuesday, how many complaints issuers have received before picking their plastic.

The U.S. Consumer Financial Protection Bureau unveiled a complaint database on its web site in one of the agency's more high-profile moves since it was created under the Dodd-Frank financial reform act.

While the initial release of figures was limited, covering less than a month, it created a ranking among credit card issuers that could leave some uncomfortable. Capital One Financial Corp (COF) tallied the most complaints since June 1.

The decision to disclose complaints drew fire from financial industry groups, which said the law does not authorize the agency to release the data publicly, that it is not verified and that complaint rates by zip code are trade secrets that should be kept private.

The CFPB disagreed, saying the law authorized the disclosures and, while it does not verify each complaint, it does check whether the consumer has a relationship with the institution.

"Consumers can look at this data and can fairly draw the conclusion that if they engage in a financial relationship with the company this is what they can expect," said Scott Pluta, acting assistant director of the Office of Consumer Response of the CFPB, which only opened its doors in July 2011.

The database, available at consumerfinance.gov, is small, showing only 137 complaints collected since June 1. But over the next year, that number is likely to grow substantially.

The agency actually began collecting complaints nearly a year ago and has received more than 16,800 of them. It plans to expand the database to include these complaints in coming months and to add complaints about mortgages and other financial services, Pluta said. The earlier data contained different fields and so was not directly comparable to the data collected since June 1.

LEAGUE TABLE

The data released on Tuesday shows Capital One received the most complaints, 33, followed by Citigroup Inc (NYS:C) with 27, JPMorgan Chase & Co (JPM) with 24 and Bank of America Corp (BAC) with 15.

Capital One topped the list despite being fifth in purchase volumes in 2011, according to rankings compiled by The Nilson Report, an industry publication. American Express Co (AXP), which had only six complaints, had the largest market share with 25 percent, followed by JPMorgan, Bank of America and Citigroup.

"We always welcome customer feedback - good and bad - as we're always focused on continuous improvement and providing a great customer experience," said Capital One spokeswoman Tatiana Stead.

A Bank of America spokeswoman said the bank's objective is to work with customers to resolve any issues they have, and Citigroup said it has been actively responding to all customer complaints, including those fielded by the CFPB. JPMorgan declined to comment.

Kenneth Clayton, the American Bankers Association's executive vice president of legislative affairs and chief counsel, said the banking industry is ready to work with the CFPB to resolve consumer complaints but called the release of the database disappointing and potentially misleading to consumers.

"Publicizing allegations that may or may not have any basis in fact raises serious questions about the balanced review we expect from our government agencies," he said in a statement.

Consumers Union, the policy and advocacy division of Consumer Reports, praised the CFPB's decision to make the database public and said it supported expanding the database to include complaints about other financial products.

"Making credit card complaints public will put added pressure on banks to avoid unfair practices and help consumers make more informed financial decisions," said Pamela Banks, senior policy counsel for Consumers Union, in a statement.

The credit card companies are required to respond within 15 days and to close the complaint with an action in 60 days, Pluta said. Banks that don't respond in time are tagged in the database. So far, only one of the 137 complaints had not received a timely response. It involved Bank of America and a request to close or cancel an account.

Pluta said the agency takes steps to stop people from gaming the system. Entries must be complete and must involve a bank the bureau supervises. If the complaint is a duplicate, the agency merges it with the original. And the agency verifies that the complainant has a relationship with the bank in question, although it can't verify the merits of the complaint. Also, the form takes time to fill out and consumers must attest that the information is true.

The agency is open to working with banks to improve controls to avoid manipulation.

"So far, we've been open 11 months and there are no suspected cases of widespread manipulation," Pluta said.

Inflation drops to 2.8% as oil prices slide

Inflation has slipped to its lowest level in two and a half years, in a rare piece of good news for Britain's recession-hit households.

The Office for National Statistics said the annual inflation rate, measured on the consumer price index, slipped to 2.8% last month from 3% in April, as falling oil prices fed through to cheaper petrol at the pump.

The ONS cited motor fuels as the biggest factor, with petrol prices falling by 4.5p a litre in a single month, to stand at ?1.37.

During May, the cost of a barrel of Brent crude oil on international markets slipped from $120 to $103. It has since fallen further, to $83.

On the retail price index measure, which also includes housing costs, inflation slipped to 3.1% in May from 3.5% a month earlier.

Though inflation is still well above the Bank of England's target of 2%, the fall should help to reassure policymakers that they can take more action to stimulate the economy without sparking a renewed surge in prices.

The Bank of England governor, Sir Mervyn King, hinted in his Mansion House speech last week that the monetary policy committee could unleash a fresh bout of quantitative easing - electronic money creation - alongside the government's new measures for kickstarting credit.

Jeremy Cook, of the currency broker World First, said the data "will trigger a sigh of relief from Threadneedle St" as it gives the Bank further leeway with possible further expansionary monetary policy, such as interest rate cuts or additional asset purchases.

Some members of the Bank's monetary policy committee (MPC) have previously expressed caution about more QE, warning that it could push up inflation, but world commodity prices have been falling in recent weeks amid fears about a slowdown in the world economy. Wednesday's minutes from the MPC's June meeting will show whether any members were calling for more QE.

The ONS said food and non-alcoholic drink prices rose by 0.3% between April and May, compared with a 1.3% increase a year ago, meaning that food prices also contributed to the downward slide in inflation.
