Experts issue guidelines for gene tests in kids

NEW YORK (Reuters Health) - Groups representing pediatricians and geneticists issued new recommendations on Thursday to provide doctors with guidance about when to test a child's DNA for genetic conditions.

The recommendations are the first collaboration between the American Academy of Pediatrics and the American College of Medical Genetics and Genomics. Neither organization has issued guidelines for genetic testing of kids in over a decade, according to one of the study's lead authors.

"What we're trying to show is a unified and consistent message about genetic testing in children," said Dr. Lainie Friedman Ross, the Carolyn and Matthew Bucksbaum Professor of Clinical Ethics at the University of Chicago.

"The first thing is what hasn't changed and the most important thing is (that) what is best for the child should be front and center for everything in pediatrics," Ross said.

That includes offering every parent the opportunity to screen their newborn children for treatable genetic conditions - such as sickle-cell disease, which can lead to chronic health problems as well as fatal sickle-cell "crises."

Newborn screening "shouldn't just be offered. It should be strongly encouraged, because the benefits far outweigh the risks," Ross said.

Testing children for diseases that don't affect people until adulthood, however, should be discouraged unless a childhood treatment may decrease the risk of complications or death, according to the experts.

For example, the new policy would recommend against girls being screened for the BRCA1 and BRCA2 gene mutations, which put adult women at a higher risk for breast and ovarian cancer.

About one in 600 women in the U.S. carry the mutations, and those women may decide to have their breasts and ovaries removed later in life.

There is no reason to test babies or children for those types of mutations because the results would not change how doctors treat the child, according to Ross.

"That's something you get pretty universal agreement on from the geneticist side, to not test children for adult onset conditions," said Dr. David Sweetser, chief of medical genetics at MassGeneral Hospital for Children in Boston.

"Giving that kind of information makes us all uneasy - especially if it's something you can't do anything about it, or if it's a test that's not 100 percent accurate," added Sweetser, who was not involved with the new recommendations.

But the experts agreed that an exception can be made if it will relieve the emotional burden of not knowing whether or not the child has a condition.

"Our feeling is, we should educate them and counsel them against it, but if they tell us its overwhelming?. We should respect that," Ross said.

The guideline authors urge that adopted children should be treated just like biological children in situations where testing is being considered. And they discourage the use of at-home genetic tests kits.

The recommendations also address the need for experts to help patients and doctors understand the results of genetic testing and screening.

Sweetser said that's an important point, because test results are often more complicated than a simple answer.

"It's not uncommon to get a patient transferred to us? to explain what the results are because the physician wasn't aware they could get such an ambiguous result," he said.

The experts also said that children being tested as possible tissue donors should have access to an advocate "or similar mechanism" to protect the child's interests.

Ross said the current statement does not address genetic testing or screening for research purposes, or analyzing a child's entire genome.

"I thought it was a well thought out policy statement. It does have some clear recommendations that I agree with. It's not overly restrictive, and it does allow a bit of latitude," said Sweetser.

Ross added that these are just recommendations, and they are not requirements.

"These are guidelines, neither organization is telling people how to practice medicine, but they're important (recommendations) because they combine the knowledge of pediatricians, geneticists and ethicists," she said.

The recommendations were published simultaneously in the journals Pediatrics and Genetics in Medicine.

It's clear that HTC is making a bold move with the imaging technology used on this phone, but what does it really mean in terms of specs and performance? Let's dive into the nitty gritty after the break.

HTC picked the word UltraPixel to brand its latest camera, just like Nokia coined the term PureView for its devices last year. The idea behind UltraPixels is to combine a physically large sensor with big pixels capable of gathering more light. With the HTC One, the company chose a 1/3-inch BSI sensor with 2µm pixels which absorb 330% more photons than the 1.1µm pixels typically found in modern handsets. This is combined with a fast 28mm f/2.0 autofocus lens similar to what's available on the One X, but slightly recessed for protection. Better yet, this shooter features optical image stabilization (OIS) just like the Lumia 920 -- it's able to compensate for motion in 2 axes (pitch and yaw) up to 2,000 times per second. With big 2µm pixels (that's Fujifilm X10 territory), a fast f/2.0 lens (vs. f/2.4 on the iPhone 5 and f/2.6 on the Galaxy S III) and OIS, the HTC One is poised to excel at low-light photography. A single LED flash is provided for those extremely dark circumstances.

We're pretty sure you've noticed the giant elephant in the room by now -- the lack of any mention of pixel count. That large sensor packs just four megapixels (!) and while anyone who knows digital photography understands that's plenty, it's still a daring move in a market driven by the megapixel myth. We'll take four million 2µm pixels over eight million 1.1µm pixels any day, but we think it's going be an uphill battle for HTC to educate the average consumer. The HTC One packs a new image signal processor (ISP) called ImageChip 2, which enables continuous autofocus in less than 200ms, and provides real-time lens compensation plus noise reduction. It also supports 1080p HDR video recording at near 30fps and 720p at 60fps with a dynamic range of about 84dB. The ISP implements a buffered capture cycle with pre- and post-shutter recording, for functionality similar to Scalado's Rewind / Remove, Nokia's Smart Shot, Samsung's Best Face and BlackBerry's Time Shift.

All this camera technology culminates with one particularly cool feature: Zoe. Named after the Greek word "life" and hinting at old zoetropes, this feature captures a 3-second 1080p 30fps H.264 video clip along with a 16:9 2688x1520 JPEG picture each time the shutter button is pressed. In burst mode, the HTC One is capable of taking 4-5 full-size stills per second while recording 1080p video. The resulting 3-second clips become animated thumbnails for your photos in the gallery. When you're ready to share your memories, smart content editing, cutting and sequencing software is used to create and upload a Zoe -- a professional-like highlight reel with images, clips, effects and music that remixes your content on the fly, complete with theme and music track synchronization. There are six themes and six music tracks to choose from, and you're given the option to deselect photos or videos. Once uploaded, the result can be shared via Zoe Share, which generates a standard URL that's valid for 30 days -- think of it as Vine on steroids, but less permanent.

In addition the the main shooter, the HTC One comes equipped with a 2.1 megapixel front-facing module with f/2.0 wide-angle (88-degree) optics that supports 1080p video capture. Dual HDR microphones provide distortion-free stereo audio recording in a wide variety of conditions, including loud venues. Unfortunately, our time with the UltraPixel camera was too short to formulate a solid opinion, but based on our experience so far, HTC's latest shooter is poised to delight both shutterbugs and casual users alike. On thing's for sure: we can't wait to take the company's latest imaging flagship for a spin.

Police: 7 foreigners kidnapped in north Nigeria

BAUCHI, Nigeria (AP) ? Gunmen attacked a camp for a construction company in rural northern Nigeria, killing a guard and kidnapping seven foreign workers from Britain, Greece, Italy and Lebanon, authorities said Sunday, in the biggest kidnapping yet in a region under attack by Islamic extremists.

The attack Saturday night happened in Jama're, a town in a rural portion of Bauchi state. There, the gunmen first attacked a local prison, burning two police trucks, Bauchi state police spokesman Hassan Muhammed told The Associated Press.

The gunmen then targeted a worker's camp for a Lebanese construction company called Setraco, which is in the area building a road, Muhammed said. The gunmen shot dead a guard at the camp before kidnapping the foreign workers, the spokesman said.

"The gunmen came with explosives, which they used to break some areas," Muhammed said. He did not elaborate and an AP journalist could not immediately reach the town, which is about 200 kilometers (125 miles) north of the state capital, Bauchi.

Adamu Aliyu, the chairman of the local government area that encompasses Jama're, identified those kidnapped as one British citizen, one Greek, one Italian and four Lebanese.

The Italian news agency ANSA later said authorities confirmed an Italian had been kidnapped in the attack. It quoted Foreign Minister Giulio Terzi saying the safety of the hostage must be given "absolute priority."

The Foreign Office of both Britain and Greece said Sunday they were looking into the kidnappings.

No group immediately claimed responsibility for the abductions, though Nigeria's predominantly Muslim north has been under attack by the radical Islamic sect known as Boko Haram in the last year and a half. The country's weak central government has been unable to stop the group's bloody guerrilla campaign of shootings and bombings. The sect is blamed for killing at least 792 people in 2012 alone, according to an AP count.

Boko Haram, whose name means "Western education is sacrilege" in the Hausa language of Nigeria's north, has demanded the release of all its captive members and has called for strict Shariah law to be implemented across the entire country. The sect has killed both Christians and Muslims in their attacks, as well as soldiers and security forces.

The group, which speaks to journalists in telephone conference calls at times of its choosing, could not be immediately reached for comment Sunday.

Foreigners, long abducted by militant groups and criminal gangs for ransom in Nigeria's oil-rich southern delta, have become increasingly targeted in Nigeria's north as the violence has grown. However, abductions of foreigners in the north have seen hostages regularly killed.

In May, gunmen in Kaduna state shot and killed a Lebanese and a Nigerian construction worker, while kidnapping another Lebanese employee. Later that month, kidnappers shot a German hostage dead during a rescue operation. Gunmen who authorities say have links to Boko Haram also kidnapped an Italian and a British man last year in northern Kebbi State who were later killed during a rescue operation by Nigerian soldiers backed up by British special forces. The sect later denied taking part in that abduction, which left Italian authorities angry that the nation was not consulted before the failed rescue attempt.

In December, more than 30 attackers stormed a house in the northern Nigeria state of Kaduna, killing two people and kidnapping a French engineer working on a renewable energy project there.

Chinese construction workers also have been killed by gunmen around Maiduguri, the northeastern city in Nigeria where Boko Haram first began. In the most recent attack, assailants attacked North Korean doctors working for a hospital in Yobe state, stabbing two to death and beheading a third. No group claimed responsibility for that attack.

Foreign embassies in Nigeria have issued travel warnings regarding northern Nigeria for months. Worries about abductions have increased in recent weeks with the French military intervention in Mali, as its troops and Malian soldiers try to rout out Islamic fighters who took over that nation's north in the months following a military coup. Last week, the U.S. Embassy in Nigeria's capital, Abuja, put out a warning following the killings of polio workers in the northern city of Kano and the killing of the North Korean doctors.

"The security situation in some parts of Nigeria remains fluid and unpredictable," the embassy said.

India, France Conclude $6 Bn Deal on Surface to Air Missile

India and France today concluded negotiations on the Short Range Surface to Air Missile nearly worth of USD six billion during the talks between French President Francois Hollande and Prime Minister Manmohan Singh, who also said talks on USD 10-billion deal for Rafale fighter aircraft are "progressing well".

After a comprehensive talks, the leaders said views were exchanged on a number of bilateral, regional and multilateral issues of common interest including defence ties, civil nuclear cooperation, counter-terrorism and situation in Mali.

Observing that India is Hollande's first Asian destination for a bilateral trip, Singh said this demonstrates the importance of this relationship between the two countries.

"President Hollande and I exchanged views on a number of bilateral, regional and multilateral issues of common interest. We reviewed progress on the Jaitapur Nuclear Power Project and reiterated our commitment to its early implementation as soon as the commercial and technical negotiations, which have made good progress, are completed," Singh said at a joint press event after the talks.

Expressing satisfaction with the progress in defence cooperation, Singh said, "Discussions on the MMRCA contract are progressing well. We have also concluded negotiations on the Short Range Surface to Air Missile, which, once approved by the Government, will be co-developed and co-produced in India," while noting that the defence ties were poised to reach a qualitatively new level.

The Rs 30,000 crore worth of SR-SAM project is a co- development joint venture between India and France and would be developed by MBDA of France and DRDO from the Indian side. The surface to air missile defence system would be deployed by the IAF and the Navy.

Hollande, also accompanied by a large contingent of French business leaders, including Dassault chief executive Eric Trappier, whose company is hoping to seal the deal to sell 126 Rafale warplanes to India in the world's biggest defence contract currently under negotiation.

On his part, Hollande said he has come to take the Indo-French strategic partnership to "yet another level" while noting that the defence cooperation reflects India's trust for French technology and France's trust for use of technology by India. "India is a country of peace", the French President added.

The two sides also inked four pacts, including one in the field of railways.

In the security and counter terrorism fields, India and France are determined to support each other when facing this scourge, a joint statement said.

"The two sides recognised that terrorism poses the main threat to Afghanistan's security and stability, as well as the need for joint concerted efforts and cooperation by countries of the region to effectively counter it, including dismantling terrorist sanctuaries and safe havens, beyond Afghanistan's border, disrupting financial and tactical support being provided to terrorist groups," it said.

Both sides agreed that Pakistan must abide by its commitment to expeditiously bring all the perpetrators of Mumbai terror attacks to justice, the statement said.

Both leaders also reiterated their strong support for ongoing efforts aimed at defeating terrorism in Mali, preserving Mali's territorial integrity, re-establishing a fully sovereign democratic government in Mali, and to contributing strongly to Mali's national reconstruction and sustainable economic development.

The leaders also agreed to encourage closer people ?to- people contact, through inter alia, easing mobility and human exchanges and promoting education, science and cultural cooperation as well as expanding trade and investment.

They also decided to promote an ambitious and balanced Free Trade Agreement between India and the EU based on reciprocity and mutual benefit which will boost bilateral economic relationship and to establish an annual bilateral dialogue between the two Finance Ministries on economic and financial issues.

Apart from fostering comprehensive sustainable urban development cooperation, including infrastructure, transport, water, waste management as well as urban planning, the two sides decided to facilitate and support investments from French companies into India and Indian companies into France which contribute to growth and employment in both countries.

Long-term space cooperation and cultural exchanges are among the four documents inked between India and France.

Under the space cooperation programme, ISRO and CNES have jointly identified the means to pursue further cooperation including possibilities through Missions, Payloads and Applications, exchange of young scientists and professionals in France and in India and conducting thematic workshops.

"France has been a longstanding partner in our space programme. Later this month, ISRO will launch the integrated SARAL satellite carrying the ALTIKA and ARGOS payloads from the French National Space Agency," Singh said.

In 2012, China became the world's biggest trading nation, with the total value of that nation's exports and imports surpassing those of the United States. Bloomberg reports:

U.S. exports and imports of goods last year totaled $3.82 trillion, the U.S. Commerce Department said last week. China?s customs administration reported last month that the country?s trade in goods in 2012 amounted to $3.87 trillion.

Newsmakers: Sharon Wendell serving term on oil and gas association board

Wendell_Sharon_K_128x175Sharon K. Wendell (pictured), an associate in the Houston office of Vorys, Sater, Seymour and Pease, says she began serving a three-year term on the Texas Alliance of Energy Producers board of directors in January.

Wendell, who says she is one of only two women serving on the 60-member board, will attend her first meeting during the 2013 Alliance expo and annual meeting April 23-24 in Wichita Falls. With about 3,350 members, the Texas Alliance is the largest independent oil and gas association in the nation, she says.

Wendell says she joined Vorys when the firm opened its Houston office in February 2009. While her practice focuses on litigation, Wendell says she has experience in oil and gas matters.

'Storage Wars' buyer Mark Balelo found dead

Mark Balelo, who appeared on A&E's "Storage Wars" as a frequent locker buyer, was found dead Monday at his California workplace, the Ventura County Star has reported.

No cause of death was cited by the Ventura County Medical Examiner's Office, though they indicated that an autopsy would be done Tuesday.?

Balelo was arrested on Saturday on suspicion of possessing a controlled substance and was scheduled to appear in Ventura County Superior Court on Feb. 19.?

The 40-year-old was the owner of Balelo, Inc., a liquidation merchandise business. He came to the media's attention in April 2011 when he returned a rare copy of a 1938 Action Comics comic book he found in a storage locker, more than 10 years after it was stolen from its owner -- actor Nicolas Cage.?

Balelo first appeared on "Storage Wars" in August 2011. On his Facebook page, he recently indicated he was "currently working on a new reality show of (his) own."

In the two page release, the MAS announces its stance on the Singapore Dollar for the next six months and the considerations behind the decision.

Unlike proclamations of growth for the economy that inevitably hogs the headlines for days on end, traders and investors tend to dismiss this announcement without much consideration. However, this little nugget of concrete information is much more important than growth figures. We examine Singapore?s Exchange Rate Policy in more detail.

1. Why do we need a Monetary Policy?

Singapore is a small but open economy. We trade with many countries all over the world.

The Singapore Dollar is the bedrock and the lifeline of this trade. Overseas companies wishing to purchase goods and services manufactured in Singapore will have to first purchase the SGD with their home currency and exchange SGD for goods and services. Say Google wishes to establish a regional office in Singapore, they would have to use their USD revenue to purchase SGD and subsequently use this SGD to pay for office rent, staff wages, advertising costs etc. This drives demand for SGD. On the same token, we produce very little of our consumption foodstuff. Most of our consumption is imported from overseas. A large portion of the rice we consume comes from Thailand, and in order to purchase rice, we need to first purchase Thai baht and use that to pay rice farmers in Thailand. This very act of purchasing THB can also be seen as selling the SGD.

In reality, the situation is a lot more complex, with individuals, businesses and institutions engaging in millions of transactions every year with elements all over the world in their unique currencies. The aggregate of this demand and supply determines the value of the SGD. If we are able to produce higher value goods and services in greater quantities, demand for SGD will increase and inevitably SGD will become more expensive. Conversely if our domestic economy falters, the SGD will be in lesser demand and its value should decrease.

2. How do currencies fluctuate?

Different countries adopt different ways of maintaining the strength of their currency. One could fix the home currency to another currency that is normally the biggest trading partner, like how the Hong Kong dollar is perpetually fixed at $7.8HKD to $1USD or the Brunei dollar at parity with the SGD. The biggest advantage of this currency regime is the stability it contributes to the economy. However, such a system would require constant intervention from the government and heaps of currency reserves to maintain some form of respectability in the currency peg. Any form of weakness detected in central bank or misplacing of the currency would bring profit seeking currency traders out in force, the most infamous occasion being how George Soros made billions from the devaluation of the British pound in 1992.

A pure floating regime on the other hand, is where the value of the currency is allowed to float freely based on market supply and demand. In nations like these, the economy dictates the value of the currency. The currency will grow in value as the economy gets stronger, and fall out of favor when the economy weakens. Most modern economies in the world operate in this manner.

3. What is the S$NEER?

The S$NEER is the Singapore Dollar Nominal Effective Exchange Rate.

The value of SGD has to be measured against something. Rather than using one single currency as a benchmark like what Hong Kong is doing, the MAS uses a basket of currencies of our major trading partners. It is trade weighted such that the currencies of our larger trading partners bears more weight and make up a more integral part of the index.

4. Is the SGD a fixed or floating currency?

Our system is a hybrid of both. SGD is allowed to float freely, and the MAS will monitor the strength of the currency based on the S$NEER. In their bi-annual statement, (normally in the last paragraph and after setting out the rationale for the move) the MAS will announce three crucial factors that governs the behavior of SGD with respect the $SNEER.

a. The slope of the band

b. The width of the band

c. The centering of the band

Within the band, the SGD is subjected to day to day fluctuations just like any other currency. Businesses from overseas can buy or sell SGD to pay local companies for goods required. Institutions can buy or sell the currency to hedge against future movements. Speculators can trade it freely based on technicals. This freedom is essential for an open economy like ours to flourish.

However, once the SGD is deemed to be trading beyond the band, MAS will step in to buy or sell SGD to maintain its trajectory within the S$NEER band. The instances are few and far in between, and my most recent memory of that happening is in 2010 when the SGD hit a high of 1.341.

Technicalities aside, what MAS is doing is essentially modulating the strength of the SGD against the $SNEER. The band prevents the currency from becoming too strong, making exports prohibitively expensive or too weak, which will lead to higher inflation. The width of the band determines the volatility. By narrowing the band, the SGD will have less room to maneuver before the MAS reins it in. The slope gives an indication of how aggressive the MAS wants to be with the policy it is adopting over the next six months.

5. How does it affect retail investors like me??

a. Interest Rates and the property market

In a monograph published by the MAS in 2001 titled Singapore?s Exchange Rate policy, the central bank recognizes that in order to manage the currency, it will have to relinquish control over the interest rates of the country.

The choice of exchange rates as the immediate target of monetary policy implies that MAS has given up control over domestic interest rates (and money supply). In the context of free capital movement, interest rates are largely determined by foreign interest rates and investor expectations of the future movement of the Singapore dollar.

When rational foreign investors see that the MAS is adopting an appreciative stance on the SGD, they will be keen to purchase the currency or assets dominated in SGD. Foreign investment will flow into the country. The woes of the US and the EU has made the SGD extremely attractive in comparison and the quantitative measures has seen billions in inflow. As a result, there will be ample liquidity and interest rates will remain low.

This low interest rate environment has been deemed one the main contributors of sky high property prices Singapore. Property investors would do well to keep a lookout for MAS?s stance on the SGD, for that will give a good indication of the interest rates and consequently, property prices.

b. Foreign investments

Investing in any assets not denominated in SGD would expose you to currency risks. Imagine you are planning to purchase shares in Apple. You will now sell SGD, purchase USD and use this USD to purchase the shares. Six months later, assuming that the price remains unchanged and you have decided to close the trade. And because the MAS has been adopting an appreciative stance for the SGD, it has now grown stronger and the same amount of USD can only get you lesser SGD. Despite the trade itself breaking even, your exposure to currency fluctuations has resulted in a net loss for this particular trade. Of course, the converse is true and should the MAS be allowing the SGD to devalue, foreign investments would become a lot more attractive.

This is especially crucial to investors looking to purchase Gold as a hedge against inflation. As the commodity is dominated in USD, any gains you might make on the asset might be eroded by the strengthening SGD.

c. Bonds

Interest rates are negatively correlated with bond prices. An appreciating SGD would lower interest rates and consequently, keep bond yields low. When interest rates increase, yields would also increase and prices of bond would decrease. The relationship between different asset classes, economic conditions and government policies is highly intertwined but unescapable.

MAS will continue to maintain a modest and gradual appreciation of the $SNEER policy band. There will be no change to the slope and width of the policy band, as well as the level in which it is centered.

AERL Switches To Sands Cotai; Aspect Gaming Buys Longshot ...

The new room will feature three gaming tables plus a private enclosure with one additional table. AERL chairman Lam Pou said the company was ?very excited? about moving into Sands Cotai, which should ?enhance our ability to better serve our existing customers and ultimately provide our shareholders with long-term value.? Shareholders have no doubt questioned the value of their investment as AERL has seen rolling chip turnover fall for the better part of a year after tightening credit for its agents on the mainland. Analysts expect AERL to loosen the credit restrictions as the year progresses.

AERL?s other VIP rooms are at Galaxy Entertainment?s Star World Hotel & Casino downtown, as well as the Galaxy Macau and Melco Crown?s City of Dreams, both of which are on the Cotai strip. The move to Sands Cotai Central may help reverse AERL?s fortunes, as analysts have projected double-digit revenue growth for casinos on Cotai in 2013, while Macau?s other casinos are tipped to grow single-digits. In the meantime, the NASDAQ-listed AERL is looking to raise $150m via a share sale.

Macau?s VIP market accounted for 69.3% of the enclave?s Q4 revenue pie, only the second time in three years that figure has fallen below 70%. The analysts at Jefferies Group are dubious about VIP?s willingness to boost their Macau outlay because the amount of money changing hands at art and antique auctions on the Chinese mainland has been falling, suggesting China?s 1% are being conservative with their discretionary spending. But Sterne Agee?s David Bain believes there?s a ?90% correlation? between Macau VIP gross gaming revenue and China?s GDP performance dating back to Q1 2009. To help ride this wave, Aspect has acquired Las Vegas-based casino games developer Longshot Interactive, whose proprietary baccarat variants will provide ?the basis for the video poker of Asia,? according to Nguyen. Longshot CEO Ameesh Patel said both companies believe the Asian market will come to be dominated by middle class gamblers, and the firms intend to cater to this sector via ?culturally relevant and compelling content.? Senate panel to vote on Defense nominee Hagel

(AP) ? Chuck Hagel ? Republican, twice-wounded Vietnam combat veteran and former Nebraska senator ? faces his first major hurdle in his bid to become the nation's defense secretary as a bitterly divided Senate Armed Services Committee pushes toward a vote on his nomination.

The panel is scheduled to meet Tuesday afternoon to discuss and vote on President Barack Obama's choice to succeed Defense Secretary Leon Panetta, who is stepping down after four years as CIA director and Pentagon chief. Senate Majority Leader Harry Reid, D-Nev., is pressing for a full Senate vote on either Wednesday or Thursday.

Hagel faces fierce opposition from Republicans who have challenged his past statements and votes on Israel, Iran, Iraq and nuclear weapons. Committee Republicans forced a delay in the expected committee vote last week when they pressed Hagel for more information about his personal finances.

The panel's chairman, Sen. Carl Levin, D-Mich., said the GOP demands were beyond the scope of those traditionally asked of previous nominees, Republican and Democrat ? a point echoed by his Republican colleague, Sen. John McCain of Arizona. Levin set a committee vote that will probably break along party lines ? 14 Democrats for Hagel, 12 Republicans against their former colleague ? just hours before Obama's State of the Union address to Congress.

More critical to whether Republicans drag out the nomination is the closed-door, weekly Republican luncheon Tuesday where Senate Minority Leader Mitch McConnell, R-Ky., will determine whether GOP lawmakers have the inclination and votes to filibuster a president's Cabinet choice. Such a move would be unprecedented in the Senate, where Republicans and Democrats have argued that a president's nominee should get an up or down vote.

Late Monday, McCain met privately with several committee Republicans and urged them not to filibuster the Hagel nomination, arguing that it would set a bad precedent and pointing out that the roles could be reversed someday with a Republican president and GOP-controlled Senate.

"I'm encouraging my colleagues if they want to vote against Sen. Hagel that's one thing and that's a principled stand," McCain told a group of reporters. "We do not want to filibuster. We have not filibustered a Cabinet appointee in the past and I believe that we should move forward with his nomination, bring it to the floor and vote up or down."

McCain has not said how he would vote on the nomination, but has indicated he was learning against confirmation.

Sen. Jim Inhofe of Oklahoma, the top Republican on the Armed Services Committee, said he is determined to do everything in his power to scuttle the nomination, though he told reporters he does not want to string out the process. Sen. Lindsey Graham, R-S.C., has signaled that he would block the nominations of Hagel and CIA Director-designate John Brennan if he doesn't get more answers about the deadly raid on the U.S. diplomatic mission in Benghazi, Libya, last September.

"I'm insisting that the president answer ... what he did that night. That's all. It would take five minutes to answer my question," Graham told reporters. "It's the only leverage I have."

The White House pushed back Monday, with spokesman Jay Carney insisting the administration had answered lingering questions about Libya and the president's actions on that fateful day.

"What is unfortunate here is the continuing attempt to politicize an issue, in this case through nominees that themselves had nothing to do with Benghazi, and to do so in a way that only does harm to our national security interests," Carney said. "Sen. Hagel, Mr. Brennan, they need to be confirmed."

All 55 Democrats are expected to back Hagel, and two Republicans ? Sens. Thad Cochran of Mississippi and Mike Johanns of Nebraska ? have said they will vote for the nominee. At least five Republicans, including McCain, have said they oppose a filibuster despite their reservations or opposition toward the nominee.

Sen. Orrin Hatch, R-Utah, said he would not support a filibuster.

"Chuck and I have been friends. I have to say I was disappointed in his performance" at his confirmation hearing, Hatch said.

Hagel seemed ill-prepared under withering cross-examination from committee Republicans in nearly eight hours of testimony on Jan. 31. He was repeatedly pressed about past statements and votes on Israel, Iran and nuclear weapons, with GOP lawmakers suggesting he wasn't sufficiently supportive of Israel or anti-Iran.

About a dozen Republicans have said they will oppose their former colleague, and several others have indicated they are likely to vote no.

Yemen minister says weapons came from Iran

SANAA, Yemen (AP) ? Yemen's interior minister said Saturday that his country was disappointed to find that a large and diverse cache of weapons seized on a ship last month had been exported from Iran, a finding Washington said underscores Tehran's ongoing evasion of U.N. resolutions.

Speaking in a press conference in the Yemeni capital of Sanaa, Interior Minister Abdel-Qader Kahtan said a Yemeni investigation found that the weapons were destined for armed insurgents. He did not elaborate, saying only that an investigation is ongoing.

He said he had hoped Iran would not "export weapons to Yemen". It was the first acknowledgement by a Yemeni official on the record to hold Iran responsible for the shipment.

The U.S. State Department said in a statement that the initial findings of the Yemeni investigation show that "Iran continues to defy the international community through its proliferation activities and support for destabilizing action in the region."

The State Department said Yemeni government officials noted that their investigation thus far shows that the weapons were loaded onto the vessel in Iran.

Kahtan's statement came days after Yemen asked the U.N. Security Council to investigate the cargo of Iranian-made missiles, rockets and other weapons. Yemeni President Abed Rabbo Mansour Hadi has warned Iran to "stop meddling" in the affairs of his country, which has for years been fighting Shiite Muslim insurgents near the country's border with Saudi Arabia.

Yemen's Defense Ministry first announced in a statement Wednesday that the country's authorities seized the Iranian ship last month, carrying material for bombs and suicide belts, explosives, Katyusha rockets, surface-to-air missiles, rocket-propelled grenades and large amounts of ammunition. Iran is governed by Shiite clerics.

The U.N.'s envoy to Yemen has not confirmed allegations that the shipment was loaded in Iran, saying that is up to a U.N. investigation to determine.

Sermanni wins debut as US women's soccer coach

JACKSONVILLE, Fla. (AP) ? This was quite the debut for Tom Sermanni, and Christen Press.

Sermanni coached the U.S. women's soccer team to a 4-1 win over Scotland on Saturday, making the most of two first-half goals by Press.

It was Sermanni's first game in charge since he was hired by the U.S. Soccer Federation in October. He was born in Scotland and spent the last eight years as Australia's coach, leading the Matildas to the quarterfinals of the last two Women's World Cups.

"It's good to get the team out on the park," Sermanni said. "What impressed me was the number of chances that they got and how they can create chances at all times. At times, some of the combinations impressed me. So just the way they focus and go about doing the job and winning games is very impressive."

Press played in her first game for the national team and had a hand in each of the United States' first three goals in the exhibition at the home of the Jacksonville Jaguars, scoring twice and assisting on the third.

"I was hoping that my first cap would be my first start and my first goal all in the same day," she said. "Sort of was going for the trifecta. My teammates made it really easy for me and I'm really thankful for that."

She got the Americans on the board in the 13th minute, taking advantage of a poor clearing attempt by Scotland. The ball was batted back in the direction of Press, who deftly lifted a kick over the defenders and goalkeeper Gemma Fay.

Press' second score came at the 32-minute mark. She took a pass from Tobin Heath and sent a header from 22 feet out into the left corner of the net.

The U.S. made it 3-0 early in the second half when Shannon Boxx got a pass from Press and lifted a kick over the outstretched arms of Fay.

"On that first goal, the clearance by the defense was a little short and it was my job to be there for anything that came out," the 24-year-old Press said. "At that point, it's just have fun, shoot and see what happens."

Press had trained in Sweden the past year and called that experience "a blessing in my life."

"I learned so much there, just seeing the different styles of soccer," she said. "All the things I've been able to learn as a person and a player has helped me prepare to play at this level."

Scotland avoided a shutout in the 54th minute. Kim Little drilled a hard shot past U.S. goalie Nicole Barnhart, who replaced Jill Loyden at intermission.

Sydney Leroux closed out the scoring for the United States, sending a loose ball into an uncontested net in the 89th minute in front of a crowd of 18,656.

The Americans stretched their unbeaten streak to 24 games (21-0-3) dating to the 2012 season.

It was only the second game between the United States and Scotland. The American women won 8-2 in the first meeting in 2002, powered by Abby Wambach's first career hat trick and the last three-goal performance by Mia Hamm.

The countries will play again Wednesday in Nashville, Tenn., at the home of the Tennessee Titans.

"This was a great start for us," Wambach said. "It's a new experience with a new coach. We tried new formations with new players and this was a great way to get things going for this year.

"Everyone was out there, having fun and this proved to be a great starting point for us for this year. We've only been together with the new coach for a short time, but we're all working hard, having fun and we're enjoying it. It's a great marriage so far."

Clearly, with so many pathways available for the production and conversion of thyroid hormones, there are a lot of opportunities for something to go wrong.

Many people are diagnosed with this condition and given thyroid medication. Sometimes, this medication will show improvements in lab analysis as hormone levels fall into normal range. But many people still have symptoms.

Suppose a U.S. military special operations unit came upon an al Qaeda training camp in Africa. It discovers terrorist trainers teaching recruits how to use automatic weapons, improvise explosive devices, and practice suicide attacks and small unit tactics. Though the personnel hail from different nations, reconnaissance suggests that some of them may be Americans.

What should the team do? Under the laws of war, the U.S. military unit can surprise the instructors and recruits with snipers and artillery as well as shooting at closer quarters. But under President Barack Obama's half-hearted approach to terrorism, revealed in Tuesday's leaked Justice Department memo, military units on the ground or drones in the air would have to pause and seek guidance from multiple bureaucrats. Instead of having the traditional authority to kill the enemy and destroy their resources, American soldiers and agents have entered a legal netherworld of Obama's creation. The speed and decisiveness of U.S. counterterrorism operations will suffer, even as the administration withdraws from Iraq and now Afghanistan, and gives up the intelligence networks there.

In place of the clarity of the rules of war, the administration has thrust American soldiers into the three- and four-factor balancing tests that govern police officers walking the beat in downtown New York. For the first time in the history of American arms, presidential advisers will sit and weigh the "due process" rights of enemy soldiers, judge whether they pose an "imminent" threat, or decide if capture "becomes feasible." Due process rights for the enemy, according to the DOJ memo, will require a careful balancing of the "nature and quality of the intrusion" on the enemy's constitutional rights against "the governmental interests." And Attorney General Eric Holder limits the target to "an operational leader continually planning attacks" against the United States.

To be clear, the memo, technically a "white paper," is correct in affirming that the United States is at war with al Qaeda. That conclusion rests on the actions of two presidents over four terms, Congress over the past decade, the Supreme Court, the U.N. Security Council, and NATO. It cannot be seriously disputed -- although some liberal critics cling to the belief that al Qaeda is simply a criminal conspiracy, not a true belligerent, and that only law-enforcement actions, not military ones, may be taken against it. Given that the United States is at war, it follows that it may legitimately use lethal force against enemy combatants, regardless of their nationality. ?Enemy soldiers, even when not engaged in active hostilities, are legitimate targets during war. If that is true of enemy soldiers in uniform, it must be true also of al Qaeda operatives, who may not wear uniforms but who are the functional equivalent of regular troops. And just as a U.S. national serving in the German Army in 1944 or the Confederate Army in 1863 could be lawfully targeted and killed, so may a U.S. national performing a military function for al Qaeda.

Despite claims that the president is asserting a radically new and menacing authority, Obama's decision to target al Qaeda operatives who are U.S. nationals is by no means unprecedented. The fact is that American presidents (and state governors) have lawfully deployed military force against citizens in insurrection, rebellion, or war against the United States from the beginning of the nation. In 1787, the very year in which the Constitution was framed, the governor of Massachusetts deployed the state militia to put down Shay's Rebellion. President George Washington personally led federalized militia troops into western Pennsylvania to suppress the Whiskey Rebellion of 1794. President Andrew Jackson threatened to use force against South Carolina in the "nullification crisis" of 1832. During the Civil War, President Abraham Lincoln deployed Union armies and navies against the Confederates who, despite being in rebellion, remained U.S. citizens. President Franklin Roosevelt directed operations against U.S. citizens fighting for Axis forces during the Second World War. President Dwight Eisenhower sent federal troops into Little Rock Arkansas when angry mobs of segregationists threatened to prevent African-American children from attending the city's public schools.

Rio unleashes "pee patrols" to clean up Carnival

RIO DE JANEIRO (Reuters) - Rio de Janeiro has in recent years evicted drug dealers from hillside slums, carved fast-moving bus lanes into sclerotic streets, and cracked down on unauthorized food vendors along the city's 58 miles of beaches.

Now, as they gear up for the 2013 Carnival, officials are taking aim at another old Rio scourge: public urinating.

Urine flows as freely during Rio's famous annual festivities as beer and the cane liquor known as cacha?a.

For as long as locals remember, the sight of people relieving themselves - and the stench of their steamy puddles - has been as much a part of Carnival as half-naked women, samba schools, drag queens, body paint, and drunk and sun-burned foreigners.

But Rio, Brazil's second-largest city and its most popular tourist destination, now wants to stop the peeing.

To sanitize some of the revelry, officially starting on Friday, city hall has deployed thousands of agents to spot and detain offenders. It's a dry run, if you will, before Rio hosts World Cup soccer matches next year and the 2016 Olympics - events that are also expected to inspire celebration.

"It's the biggest complaint we get," says Alex Costa, Rio's secretary for public order, echoing angry residents whose doors, curbs and car tires get anointed by bursting bladders.

In recent weeks, the city has touted the number of "mij?es," or "pee-ers," that agents have detained during pre-Carnival rehearsals and block parties: 321 since January 20, including 16 women and three foreigners. Particularly lewd offenders are fined, but most detainees merely get shuttled to police stations where they miss the rest of the party.

"We just want to educate," Costa says, "give people pause."

CARNIVAL REBOUNDS

The pee patrol is part of an overall effort to impose more order as Carnival's popularity soars.

Like Mardi Gras and other similar celebrations, Rio's Carnival stems from the tradition by some Catholics to get sins out of their system before the austere season of Lent.

Not too long ago, a volatile economy and rampant crime relegated most of the celebration to a sterile, concrete promenade where professional parade organizers compete in a televised spectacle. It's a far cry from grass-roots revelry.

As Brazil's economy rebounded in recent years, city officials cleaned up Rio's marquee neighborhoods. Block parties and amateur street parades blossomed; adding to events expected this year to generate $665 million for the local economy.

In the past four years, the size of marches by neighborhood groups, trade organizations, and other cliques has doubled, attracting a projected 6 million people this Carnival. Nearly 500 "blocos," as the bibulous bunches are known, are scheduled to march by Carnival's end next Wednesday.

To cope, the city has deployed 18,000 portable toilets around town. Along with thousands of police already on patrol, 7,700 municipal agents, more than twice as many as last year, control everything from unlicensed street vendors to illegal parking.

They're also pursuing pee-ers.

'DISGUSTING PIGS'

Last Sunday, 25 of the agents worked Suvaco de Cristo, or Christ's Armpit, a popular "bloco" that parties beneath the right arm of Rio's iconic Christ the Redeemer statue.

In plain clothes so as not to draw suspicion, the agents stood out anyway among 25,000 partiers donning everything from lingerie and Angry Birds masks to grass skirts and devil suits.

The agents milled about side streets and a nearby canal, where their targets might drop trousers. They looked behind trees and between cars, where female offenders often squat.

At first, the pickings were slim. "They haven't drunk enough yet," said Marcelo Maywald, who leads the patrols.

But soon enough, two men in miniskirts, blonde wigs, and sailor caps stumbled toward the wall of a hippodrome. Four agents surrounded the men just as they started to urinate.

Though perturbed, the "mij?es" finished the task at hand. When they turned, the agents accosted them. "Come with us," one agent said. "You know you shouldn't do that."

Nearby, Maywald nabbed a shirtless man in a straw hat.

The agents walked the three offenders to a curb while they radioed for a nearby van. "Don't worry," Maywald stressed, "this isn't about punishment. We just want to build some awareness."

The agents, in fact, aren't armed; they don't even carry handcuffs. Sensing as much, the man in the straw hat ran off.

"He's quicker than us," one of the wigged men said, "or maybe he's just more sober."

Maywald wasn't amused. "That was one of mine," he griped.

He and two agents then hopped into a pickup truck and sped to pass the procession. The "bloco" crept behind a sound truck past the colonnade of palm trees lining Rio's botanical garden.

In a square, the revelers rallied like runners at the end of drunken marathon. Catching "mij?es" was like shooting fish in a barrel.

One woman clapped as the agents caught them. "You are disgusting!" she yelled at the offenders. "You are pigs!"

Meanwhile, Felipe Rodrigues, a 21-year-old soldier in plaid shorts, unzipped by the side of a bush. Maywald snuck to the other side and pretended to field a phone call. When Rodrigues was done, Maywald walked over and collared him.

Five minutes later, Rodrigues sat in an open van while two friends taunted him. "Can you give us a ride?" they asked.

Rodrigues, still buzzed from his morning beer, shrugged. "Of course, I was in the wrong," he said, "but I really had to go."
