Hobby Lobby, the popular arts and crafts chain, has thrown down the gauntlet to the Obama administration.

The company issued a statement Thursday saying it will refuse to offer access to the controversial ?morning-after? birth control pill as part of its health care coverage despite risking fines of up to $1.3 million dollars a day.?

Obamacare requires employers to offer such birth control options via their health care plans ? even for companies with religious objections. Hobby Lobby is owned by the same conservative Christian family that also owns publisher Mardel Incorporated. They are suing to block the part of the health care bill that requires employers to provide insurance coverage for the ?morning after pill? and other emergency contraceptive measures.

According to Newser.com:

The companies claim the mandate violates the religious beliefs of their owners. They say the morning-after pill is tantamount to abortion because it can prevent a fertilized egg from becoming implanted in a woman?s womb.

In ruling against the companies last month, U.S. District Judge Joe Heaton said churches and other religious organizations have been granted constitutional protection from the birth-control provisions but that ?Hobby Lobby and Mardel are not religious organizations.?

That is why the family has opened a new lawsuit against the health care bill and the contraceptive provisions. A visit to their Facebook page shows well over 700,000 likes and nearly 17,000 people talking about them. We?re pretty sure those numbers will increase once word of this gets around about them standing up for religious freedom against the Obama health care bill.

Is your home getting to hot in the day or is your home too bright for your liking? If so, you should try tinting the windows in your home. This is a fairly easy process that most people can do on their own. Additionally, tinting your windows saves a lot on your cooling bill.

There are many tutorials that can be found on any type of home improvement, probably more than you could possible imagine. Whether you find these tutorials online, in books, or from a friend, it is a great help to review these before and during the home improvement process. If you do not have the knowledge you need, you could be stuck with not very functional work.

These tips will help empower you to do your own repairs, replace what needs replacing, or remodel any room in the house, if you so choose. Having an amazing home doesn?t have to be something you leave to other people, and by following tips like these, you?ll get more skilled and more capable at making all the home improvements you dream of making.

Can I Change My Will to Avoid Estate Tax? And More Free Tax Q&A ...

Robb: My in-laws are thinking of changing their wills so that individual items are bequeathed directly to specific heirs as opposed to out of the estate, as such. Is there any tax benefit to this?

Corporate Tax Network: Hi Robb, The estate tax is based on the ?taxable estate?. The taxable estate covers all of the items owned by your in-laws. How those assets are transferred, either through direct bequest or through the estate, will not change the size of the taxable estate. The main benefit in using a specific bequest is to try to minimize any family mis-understandings about the disposition of property. The taxable estate can be reduced by making lifetime gifts to individuals. A couple can make a gift of $26,000 ($28,000 in 2014) to any individual without tax consequences.

Dom: HI Gary: Let?s say you just changed over from a sole proprietorship (on Dec 19) to LLC. Does this affect filing for 2012? Also, how does the EIN come into play in 2013 if you?ve filed jointly with your spouse in 2012, any change?

Corporate Tax Network: Hi Dom,
If you registered an LLC on 12/19, then your business activity from 12/19 to 12/31 would be reported on the LLC?s tax return. If this is a single member LLC, the activity would be reported on a schedule C, on form 1040, and if it is a partnership it would be reported on form 1065. If you have determined to elect for your LLC to be taxed as an S-corporation, then your business tax information would be reported on form 1120S, and if you elected C-corp tax treatment, then it would be reported on form 1120.
If you have a single member LLC, and are not making any special elections, you would only need to file a schedule C if the business was active and had some financial activity during the year. If there was no activity, you would not need to fill out a schedule C, however some states do require a separate return filing for LLC?s regardless of whether there is activity or not.
If your business is taxed as a partnership, S-corp or C-corp, you would have to file a federal return, even if you did not have any activity. If your state requires the filing of a state return, you would need to file that as well.
You can still file a joint return with your spouse going forward.

Beverly: If I make less than $13k a year do I have to file taxes? My husband doesn?t work & has no income.
Also, I?m 58yrs old, disabled can I claim Homestead on my home yet? Thx

Corporate Tax Network: Hi Beverly,
If you are filing as married Filing Jointly, and your combined income is less than $19500 (and you are not self employed) then you would generally not be required to file a tax return. However you may still want to file if you are expecting a refund or if you are eligible for any tax credits.
With regard to the homestead credit for South Carolina, if you are not age 65 or older, then you would qualify if you were declared totally and permanently disabled by a state or federal agency or are legally blind.

Julie: I bought a second house this year in a different state. What are the tax implications? Do I need to file a state return in that state? I do not live there full time, but most weekends. Does that matter? I still have a mortgage on both homes. Thanks

If you have any earned income or rental income within the state where you purchased your second home, then you would need to file a state return. If this is your second home, you would be able to deduct the mortgage interest on your Schedule A-itemized deductions, assuming your mortgages combined, don?t exceed one million dollars.

Andrew: I have an LLC that I didn?t use/or pay the franchise tax for 2011. I think I filed the paperwork to close it correctly, but I?m not sure. How can I check?

Corporate Tax Network: Hi Andrew,
Most state (Secretary of State) websites allow you to search your business information. You should be able to see the status of your business by searching the SOS business database and find out whether it is active, dissolved, in bad standing, etc.
If your company is in bad standing, or involuntarily dissolved by the state, you can reinstate the business by filing the outstanding forms (annual reports, tax returns, etc) and paying the penalties and interest associated with the late filing. However if you dissolve the company, you would need to form a new one. The filing requirements for each state vary. You should contact the Secretary of State where the company is registered, in order to obtain the forms necessary for either reinstating your business or registering a new one or work with a professional to get all the paperwork filled out.

Andrew: I?ve checked the SOS site my LLC is still active under status. Where do I find out if there are any fees and penalties due?

Corporate Tax Network: Andrew, if the state website shows the company as active, it?s an indication that the dissolution documents you submitted are either incomplete or have not been processed yet. You may need to contact the state directly to determine whether they have processed the paperwork you sent to them. You should file form 568- Limited Liability Company Return of Income, and pay the $800 franchise fee for 2011 as soon as possible. Also please make sure you file your 2012 tax return and make the tax payment by April 15th.

Debbie: Can you contribute to a college savings plan (Ohio?s 529) up until April the following year? Or does the contribution have to happen in the tax year, by December 31st?

Corporate Tax Network: Hi Debbie, the contribution deadline for the Ohio 529 College Savings Plan is December 31st. It would have to be made during the tax year.

Emma: HI my tax question is this. I am currently receiving an annuity from CalPers in Ca. If I move to Arizona would I have to pay any state income tax in either CA or AZ?

Corporate Tax Network: Hi Emma,
California taxes pensions that were earned there. If you now live in Arizona, you would need to report and pay tax on all income in Arizona as well. You should be able to get credit for state taxes paid to CA on your AZ state return.

Frederick: Refinanced primary home and removed my sisters name from the deed. However added my wife instead. I then recently got a letter from the county assessor about filling out a firm of the transfer is from parent to child. However this is not the case. What should I do?

Corporate Tax Network: Fredrick, I would suggest to contact the county assessor to determine why such a letter was sent. They may have incorrectly reported your wife, as your child. You may also want to discuss this issue with a legal advisor in case a resolution cannot be reach with the county assessor?s office.

Mel: Do we need a tax accountant to complete annual K-1 Partnership for an apartment building that is jointly owned by 2 other partners? We are in our second year of our partnership and seems we can just carry over the depreciation numbers into the next year along with our expenses and income for the year.

Corporate Tax Network: Hi Mel,
In order to complete the Schedule K-1?s, you would need to first prepare the partnerships tax return form 1065. If you have prepared the returns in the past, along with the Schedule K-1?s and are familiar with the reporting requirements and filing procedures, and feel comfortable continuing to file on your own, without professional assistance, then you can do so. If you are not familiar with business taxation, filing and reporting requirements, I would suggest working with a CPA/EA to prepare the partnership tax return and the schedule K-1?s.

Oscar: I?m going to be ?self employed? stating 1/1 . What paperwork will I be needing to take care of? Thanks

Corporate Tax Network: Hi Oscar,
Self employment income is reported on a schedule C, on your personal income tax return. The income would be subject to self employment taxes (15.3%) and income taxes. In order to pre-pay your taxes and avoid getting hit with an underpayment penalty, you should make estimated tax payments. (federal and state)

You can also minimize your tax liability by contributing up to 20% of your self-employment income into a retirement account. You should consult with a CPA or EA to determine the best tax reduction strategies based on the nature of your-self employment business, revenue, and future goals.

Stan: Stan, unfortunately the law requires IRS to charge late filing penalties, late payment penalties and interest on any tax returns that are not filed and/or tax not paid on time. However they do allow for a penalty waiver if there is a reasonable cause. I would recommend you discuss your situation with an Enrolled Agent or Certified Public Accountant to determine if your reason for accumulating back taxes has a reasonable cause for a penalty waiver.

Reginal: I am a real estate agent in NYC, I was thinking of starting a corporation. Which one should I start and why?

Corporate Tax Network: Reginal, this is a very good question. As accountants usually say the answer is ?it depends?. If one was better than the other, everyone would just set up the same kind of business entity. Things to consider are income level of the business, any other income you have personally, NYC corporate income tax vs Unincorporated Business Tax and the most important item is whether the real estate company would be able to pay you through a corporation or if the law requires them to pay you personally. If they are able to pay you through a corporation I would consider either a Subchapter S Corporation or an LLC, depending on various outside factors. You should discuss this in private with a tax advisor. If New York law requires real estate companies to only pay commission to licensed agents and not their companies you might not have much of a choice here.

Michelle: Hi! I am recently divorced, the beginning of November it was finalized, and I have a child whom I have full custody of. I want to know how I should file my taxes because I?m unemployed. My ex-husband is telling me to file jointly with him but I feel like that?s illegal because we aren?t married anymore. And I don?t think how you file goes by whether you were married most of the year. I?m really confused and refuse to defraud the government. Please help!!

Corporate Tax Network: Michelle, since you are officially divorced you cannot file a Married Filing Joint return unless you re-marry in the next 11 days and file it with your new husband. Since you are not legally married and have a custody of a child who is your dependent, then your filing status would be Head of Household. Your ex husband can only file as single, unless he remarries or has other dependents of his own that he has custody of.

Rachel: How much do get back when u have a 10 year old and a 15 year old

Corporate Tax Network: Rachel, your refund depends on various factors. Generally, if your income is under certain threshholds, you would qualify for earned income tax credit. You may need to work directly with an accountant, and provide your income, filing status, etc to determine how much you would get back.

Mike: I have a nonprofit that became incorporated this month (via Legal Zoom). Can I write the startup costs off on my taxes (such as the incorporating, website, and equipment)?

Corporate Tax Network: Mike, the non profit- organization should reimburse you for your expenses. Otherwise you can claim this as a charitable contribution on your personal return, once the organization obtains its 501c3 status from the IRS.

Gunman kills woman at Pa. church, 2 men elsewhere

HOLLIDAYSBURG, Pa. (AP) ? A man fatally shot a woman decorating for a children's Christmas party at a tiny church hall and killed two men elsewhere in a rural township on Friday before he was shot dead in a gunfight with state troopers.

Three troopers in patrol cars were injured in a pursuit that began after the gunman, driving a pick-up truck, fired at them, police said. One trooper injured a wrist and then was hit in the chest but was saved by a bulletproof vest.

The gunman was killed during a final exchange of gunfire after ramming his truck head-on into another police cruiser, authorities said.

The shootings began in Frankstown Township, in central Pennsylvania, at about 9 a.m., and investigators were processing five crime scenes within about a 1.5-mile radius, authorities said at a news briefing Friday afternoon. Troopers were responding to a 911 call of a shooting in the township when they heard calls reporting at least one other shooting elsewhere, state police said.

"It's going to take us some time to put this all together ... and know exactly what occurred," said Lt. Col. George Bivens, deputy state police commissioner.

Authorities did not release the names of the victims or the shooter, though they did say the man lived in Blair County.

State police said they were still trying to piece together a timeline and motive. The gunman and the victims weren't related, though the victims may have been, at least distantly, Blair County District Attorney Rich Consiglio said.

Besides the woman, Bivens said, one man was shot at a residence, and the other man was shot at a crash site where the gunman "used his truck and also struck that vehicle much in the same manner that he did to our state police officer."

But family members of the victims said they were told the woman at the church was the first victim shot, the Pittsburgh Tribune-Review reported. The gunman then shot two men in the driveway of a home after a confrontation at a stop sign, one of the men's cousins, Marie Brenneman, told the newspaper.

"This person went to their driveway with a pistol, pointed at them and started shooting," Brenneman said.

She said both men were the shooter's neighbors in the tiny village of Geeseytown, about 70 miles west of Harrisburg, the state capital.

"They were uneasy around him," she said.

The woman at Juniata Valley Gospel Church had cooked food the day before for the funeral of the church's longtime pastor, said the Rev. James McCaulley, his brother. The church was still reeling from the Rev. David McCaulley's death when the woman returned to decorate its hall ? named after the pastor of 58 years ? and bullets ripped through a window, he said.

The gunman then entered and shot one of two women before he left, the reverend said.

Police identified the five crime scenes as the church; a home and ground around the home; a crash site where another victim was killed; the point in the road where the gunman opened fire on the troopers; and where the final encounter occurred after the truck collided with the police cruiser.

Bivens said investigators don't know if the victims were picked at random.

Besides the trooper wounded twice, a second trooper was injured by glass fragments in his eye and bullet fragments that hit him in the forehead, Bivens said. The third trooper suffered minor injuries from the head-on crash, he said.

"I think we have three very fortunate state police members tonight," Bivens said. "We are very thankful for the fact that they survived this attack. Someone was watching over them."

McCaulley, who is the pastor of another church about 50 miles away from the site of Friday's carnage, said his older brother began leading the Frankstown church in 1954.

"He preached his last sermon at the church in October before he fell ill," McCaulley said.

The church, which lists about 150 members in an online want ad posted this month for an associate pastor, is close-knit, and the woman killed Friday was among its more active members, McCaulley said. She had made food for him to take home Thursday since his wife had died this year, he said.

"The only thing I can say good at this time is that (the gunman) didn't do this 24 hours earlier when there was a big crowd in the church hall," McCaulley said. "We're devastated."

Friday's shootings were the second involving a rural Pennsylvania church this month.

An elementary school teacher is jailed on charges he fatally shot his ex-wife, a church organist, during a service in Coudersport on Dec. 2. The pastor and church members subdued him until police arrived.

Facebook?s Status Box Gets More Personal, Asks You ?What?s Going On?? By Name

red name tagHere’s something quite interesting, coming from Facebook on a day when it launched its SnapChat competitor, “Poke”. It seems like the company is testing out a design that is a bit more…personal. We’re familiar with the prompts within the status box when we log into Facebook and sit on our News Feed. Today, I noticed something different. It asked me what was going on, by name. We’ve reached out to Facebook for comment, but these are the types of design and user experience tests that we see in the wild all of the time. It’s interesting to note that this might be a very interesting technique to get people to share more. Seeing it was like getting a call from someone and them saying “Hi, Drew” rather than “May I speak to Mr. Olanoff?”. That slight difference might increase the number of status messages that people share on a daily basis. At least, that’s what Facebook is hoping, I’m sure. Either way, it’s an interesting experiment, and one that makes Facebook look a little more human, something I feel that it’s been lacking as of late. Sure, it’s a social network, but when your friends’ content is surrounded by ads all of the time, you tend to lose that personal touch. Having said that, the more items that are shared, the more you’ll come back to the site and to more opportunities for Facebook ads. Have you seen this on Facebook? Steve Jobs' yacht impounded over unpaid bill

AMSTERDAM - A superyacht built for Apple Inc's late co-founder Steve Jobs has been impounded in Amsterdam because of a dispute over an unpaid bill to designer Philippe Starck, a lawyer said on Friday.?

Jobs, who died last year after making his name and fortune at Apple, never got to use the yacht - called Venus - but had commissioned the French designer to work on the vessel, which cost more than 100 million euros to build.?

A lawyer representing Starck's company Ubik told Reuters his client had received 6 million euros out of a 9 million euro commission for his work on the minimalist vessel and was now seeking to recover the rest of what he was owed.?

The yacht was impounded on Wednesday evening, the lawyer said, and will remain in Amsterdam port pending payment by lawyers representing Jobs' estate.?

"The project has been going since 2007 and there had been a lot of detailed talk between Jobs and Starck," Roelant Klaassen, a lawyer representing Ubik, said.?

"These guys trusted each other, so there wasn't a very detailed contract," he said.?

The lawyer representing Jobs' estate could not immediately be reached for comment.?

Douglas wins female athlete of the Year honors

When gymnast Gabby Douglas allowed herself to dream of being an Olympic champion, she imagined having a nice little dinner with family and friends to celebrate.

Maybe she'd make an appearance here and there.

She says it's gotten far crazier than she ever thought it would.

And now the teenager who became the first African-American gymnast to claim gymnastics' biggest prize ? the all-around Olympic title ? has a new honor. She is The Associated Press' 2012 female athlete of the year, edging out swimmer Missy Franklin in a vote by U.S. editors and news directors.

She is the fourth gymnast to win the award, and first since Mary Lou Retton in 1984.

Protein kinase Akt identified as arbiter of cancer stem cell fate

Dec. 20, 2012 ? The protein kinase Akt is a key regulator of cell growth, proliferation, metabolism, survival, and death. New work on Akt's role in cancer stem cell biology from the lab of senior author Honglin Zhou, MD, PhD and Weihua Li, co-first author, both from the Center for Resuscitation Sciences, Department of Emergency Medicine, Perelman School of Medicine, University of Pennsylvania, and Xiaowei Xu, Department of Pathology and Laboratory Medicine, appears in Molecular Cell.

The findings were also highlighted in Nature and Science reviews.

This new research shows that Akt may be the key as to why cancer stem cells are so hard for the body to get rid of. It has been documented that frequent hyperactivation of Akt kinases occurs in many types of human solid tumors and blood malignancies. Prior to this work, Akt was also shown to play a pivotal role in the fate of other types of stem cells, though those cellular mechanisms are still unclear.

"When I came to Penn in 2009, my lab first found that Akt regulates the activity of the protein Oct4," explains Zhou. Oct4 is one of the four transcriptional factors used to generate induced pluripotent stem cells, or iPS cells. In 2006, Kyoto University researcher and Nobel Prize winner Shinya Yamanaka expressed four proteins -- Oct 4 was one of the -- in mouse somatic cells to rewind their genetic clocks, converting them into embryonic-like iPS cells.

The biochemical experiments outlined in the Molecular Cell paper confirmed that Oct4 interacts directly with Akt and the adding of phosphate molecules to Oct4 by Akt regulates its stability, where it localizes in a cell, and its effect on gene expression. Akt phosphorylating Oct4 has the effect of making Oct4 migrate into the nucleus, where it interacts with other transcription factors and regulates target genes transcription.

The findings were further extended into embryonal carcinoma cells, which are derived from teratocarcinomas and often considered the malignant counterparts to embryonic stem cells (ESCs). The team showed that embryonal carcinoma cells with deregulated Akt activation and more phosphorylated Oct4 are more resistant to cell death signals such as ultraviolet irradiation and high glucose treatment.

Since Akt activation is often deregulated in cancer and Oct4 expression is upregulated in cancer stem cells of various types of cancer, the researchers are studying whether the Akt/Oct4 pathway plays similar roles in other types of cancer stem cells in addition to embryonal carcinoma cells. If true, Akt inhibitor may be developed as a new drug for killing cancer stem cells in cancer therapy.

The Molecular Cell work was been done in collaboration with Binghui Shen and Yingjie Wang from Zejiang University in China.

Child Gun Deaths Nationwide Number Nearly 6 Newtown Massacres

Police reports about the final moments of Demetrius Cruz?s life include the kind of information that is at once difficult to fathom and yet somehow part of the ordinary but tragic tapestry of life in the U.S.

Cruz was riding in a car with his cousin on a Denver street Saturday when the driver of a white car started bumping, following and then chasing the teens' car. Cruz called his aunt. He was scared. Someone in the white car fired several shots, striking and killing Cruz. He was just 15 years old. That same night in Kansas City, Mo., a bullet sliced through the body of 4-year-old Aydan Perea while he was sitting in a car with his dad. Police say Perea was the innocent and unsuspecting victim of a gang drive by. Days later, on Tuesday, Dalton Williams, 16, was killed in Pierre, S.D. with a shotgun wielded by a friend after a dispute over a paintball game.

In each case, local newspapers and television stations captured the shocking and sad details. But no national media camped outside the boys' homes, schools or places of worship. No satellite trucks were driven in to beam the faces of these human sacrifices to America?s gun violence problem abroad. The president did not call to offer his condolences. Nor did he come to town to give a speech. And no professional athletes sent their jerseys or spoke publicly about the boys' deaths.

Beyond their families and friends, the deaths of Cruz, Perea and Williams and the hundreds of others like them across the country this year went largely unnoticed. The mass shooting at Sandy Hook Elementary School in Newtown, Conn. a week ago left 20 children and six adults dead, and millions of Americans distraught and, in some cases, interested anew in a conversation about gun control.

Cruz, Perea and Williams are just another string of child shooting victims whose deaths somehow seem not uncommon because they happened one at a time. Together though, child shooting fatalities in the U.S. last year alone amounted to more than two dozen Sandy Hook massacres -- and the country has scarcely reacted.

In 2011, guns were used to murder 8,583 people living in the U.S., according to the most recent FBI data available. Among those murdered by guns, there were 565 young people under the age of 18, and 119 children ages 12 or younger -- the latter number nearly equivalent to six Newtown mass shootings. And these figures include only homicides.

?It?s staggering,? said Lindsay Nichols, an attorney with the California-based pubic interest law firm and gun-control advocacy organization the Law Center to Prevent Gun Violence. ?We are all shocked by the news in Newtown, Conn., but when you think about it, it is equally tragic and equally horrific every day so many families suffer this loss and that every year there are so many funerals of children that family members have to attend.?

Just Tuesday, Paul Samplteton Sr. found the body of his 14-year-old son, Paul Sampleton Jr., bound and shot dead in the family?s Grayson, Ga. home. Police suspect the boy may have interrupted a robbery. The Sampleton family will mark a very different kind of Christmas this year, then bury their son next Friday.

Then there are the stories of children killed in gun accidents and suicides. In 2010, the most recent year for which detailed Centers for Disease Control data is available, 129 people between the ages of 1 and 19 died in gun accidents. Another 749 took their own lives using a firearm, most of which were owned by a parent.

This year, in the days leading up to the mass shooting in Newtown, 12-year-old Demetri Phillips was shot and killed by a friend while playing with a gun in their shared home on Dec. 6. Two days later, Craig Allen Loughrey, 7, died in a gun store parking lot. His father?s gun went off inside the family truck and struck the boy, strapped into a booster seat, in the chest.

The problem isn?t exactly new. In 1997, the Centers for Disease Control found that in the U.S. the rate of death among children 15 and under due to gunshot wounds was nearly 12 times higher than those in 15 other developed countries. Child deaths caused by guns have dropped since that time, along with other types of crime.

But the number of children and teens killed in 2008 and 2009 in the U.S. alone could fill 229 classroom with 25 students, according to a report released by the Children?s Defense Fund this year. In 2009, of all the people 18 and under that died due to a firearm injury of any kind, 43 percent were black and 20 percent were Latino, making gun violence a disproportionately common event among teens of color, according to the Children's Defense Fund report.

On Friday, National Rifle Association vice president Wayne LaPierre proposed a program that would put armed guards and perhaps other adults with guns in every school, saying ?good guys? with firearms were the surest way to protect the nation?s children.

Nichols, of the Law Center to Prevent Gun Violence, described the NRA?s proposal as preposterous.

?I think it?s an absurd and dangerous idea,? Nichols said. ?But as with so many of their proposals I think its real aim is to encourage the sale of more firearms. The biggest donors to the NRA are firearms manufacturers. Besides, arming and equipping all these people he wants to put in schools, having guns where kids see them daily is a tool to market weapons to the next generation.?

Global corporate deals nearly halved in 5 years

LONDON (AP) ? The value of mergers and acquisitions deals around the world in 2012 was nearly half the amount made five years ago, when the financial crisis first bared its teeth, a leading accounting and consulting firm said Wednesday.

Despite big deals such as Rosneft's takeover of fellow Russian oil company TNK-BP for a projected $54.5 billion, and Glencore International PLC's $45.8 billion acquisition of miner Xstrata PLC, Ernst & Young is forecasting that the value of global M&A was 47 percent lower in 2012 at $2.25 trillion, against 2007's $4.3 trillion. The company noted a shift in activity from developed economies to high-growth ones in Asia and Latin America ? the value of deals in the U.S. halved while those in China doubled.

There were a little under 37,000 deals worldwide, around 9,000 less than in 2007, when many companies took part in a feverish bout of deal-making, many of which proved to be too costly for the companies to bear. Much of the blame for Royal Bank of Scotland PLC's near-collapse in 2008, which eventually required a government bailout, was due to its over-priced purchase of a large chunk of Dutch bank ABN Amro the year before.

The excess of corporate deals in 2007 contributed to the near freezing of credit markets that year and paved the way for the global banking crisis in 2008 and the subsequent global recession.

However, Ernst & Young said this year's slump in corporate activity was mainly due to the uncertainty created by the debt crisis afflicting the 17 European Union countries that use the euro as well as fears over the impending "fiscal cliff" of automatic spending cuts and tax increases in the U.S.

"Acute caution was the prevailing M&A sentiment in 2012," said Pip McCrostie, global head of Ernst & Young's M&A division. "The eurozone crisis continues to impact 9 global companies in every 10 and in 2012 we saw its impact reduce the appetite for M&A, even in many formerly deal-hungry emerging markets. Limited deal activity will likely continue through 2013, especially if we don't see a clear, long term resolution to the fiscal cliff."

One clear consequence of the eurozone debt crisis in Europe has been to lower the currency bloc's share of the deals that do take place. In 2007, the eurozone accounted for around 21 percent of the global value of M&A. That's now down at 11 percent.

While the eurozone has suffered, the so-called BRIC countries? the fast-growing economies of Brazil, Russia, India and China ? are filling the gap. They accounted for 15 percent of the global M&A market in 2012, more than double 2007's rate of just 7 percent.

Even if the rapid growth of the BRIC countries over the previous few years wasn't fully sustained in 2012, the global M&A landscape has transformed over the past five years. Since 2007, the value of China's M&A market has doubled, while that of the U.S. has halved, Ernst & Young found.

"China's growing global economic influence, along with the other emerging economies, has been a re-occurring narrative over the past decade," said McCrostie. "Now the numbers tell their own story ? the shift in the balance of M&A power has accelerated since the financial crisis and it will likely become even more pronounced in 2013."

Ernst & Young found that China will be the preferred investment destination in 2013. The U.S., India, Brazil, and Germany completed the top five.

The survey, conducted in October, compiles the views of 1,500 senior executives from large companies around the world and across industry sectors.

Bryant eclipses 30,000, Lakers beat Hornets 103-87

NEW ORLEANS (AP) ? Before Kobe Bryant had even turned in his latest dominant performance, NBA Commissioner David Stern sought him out to offer a congratulatory hand shake for the extraordinary scoring milestone the Lakers star was about to surpass.

Stern assumed Bryant would score the 13 points he needed to become only the fifth player in NBA history to reach 30,000, and who wouldn't?

Bryant had 17 points by halftime, finished with 29, and Los Angeles snapped a two-game skid with a 103-87 victory over the New Orleans Hornets on Wednesday night.

"He just congratulated me and told me I was one of the best competitors that he's seen in this game and I really appreciated that," Bryant said of his pregame exchange with Stern.

Now Bryant in is elite company. The only other players to score more than 30,000 are Kareem Abdul-Jabbar, Karl Malone, Michael Jordan and Wilt Chamberlain.

"It's pretty awesome," Bryant said. "These are players I respect tremendously and obviously grew up idolizing and watching and learned a great deal from."

When Lakers coach Mike D'Antoni was asked before tipoff about Bryant's impending milestone, the coach joked, "That just means he is old."

In fact, at 34, Bryant is younger than the other four were when they hit the mark, but Bryant also turned pro at 18, and is in his 17th season.

"Honestly, I don't know why I'm still working as hard as I am after 17 years," Bryant said. "I enjoy what I do. I think that's the thing that I'm most proud of: every year, every day working hard at it. It's a lot of years, a lot of work."

Bryant eclipsed the scoring milestone with a short jumper late in the first half that was perhaps the least spectacular of his baskets, which included the usual array of soaring dunks, demoralizing transition 3-pointers and turnaround, off-balance jumpers.

Dwight Howard added 18 points and five blocked shots for the Lakers, who trailed 48-47 at halftime but seized control with a 13-0 run to open the third quarter, and the lead grew as large as 20 in the fourth.

Ryan Anderson scored 31, hitting 5 of 8 3-pointers for the Hornets, who were playing their ninth straight game without top overall draft choice Anthony Davis. Greivis Vasquez added 16 points, while Robin Lopez scored 15 points and blocked five shots.

Anderson said Bryant "deserves all the recognition that he gets."

"He's a special guy to play against. Unfortunately, we didn't get the win," Anderson added. "I would have liked him to get the 30,000, but for us to get the win."

Antawn Jamison scored 15 and Metta World Peace 11, and Chris Duhon had 10 assists for Los Angeles, which is playing without Steve Nash and Pau Gasol and won for only the second time on the road this season. The Hornets fell to 3-7 at home and lost for the 10th time in 12 games overall.

The Hornets led from early in the first quarter until halftime, going up by as many as eight points when Al-Farouq Aminu slammed down an alley-oop lob from Vasquez, energizing the largest crowd of the season at the New Orleans Arena.

Bryant helped the Lakers trim their deficit after that, hitting five free throws and his milestone on 3-foot jumper in the last 2:15 of the second quarter.

Jamison opened the third-quarter onslaught with 3, Howard followed with a fast-break layup and Bryant had two straight fast-break dunks, one of which he created himself with a steal. Howard finished the surge with a layup.

"I just didn't think our defense was there, especially that first five or six minutes of the third quarter," Hornets coach Monty Williams said. "Our defense was really poor, and we can't afford those lapses."

Anderson's shooting helped the Hornets pull to 70-62 late in the third period, but Bryant hit an 18-footer and Jodie Meeks added one of his three 3-pointers to give Los Angeles a 13-point lead heading into the final period. Meeks and Darius Morris then added 3s early in the period and New Orleans could not recover.

Afterward, Bryant sat in his locker, reflecting on the elite company he now keeps in NBA history, and the things he sees in younger prolific scoring stars like Oklahoma City's Kevin Durant, who the Lakers will see next on Friday night, and who could very well join the 30,000-point club at the rate he's going.

One common characteristic, he said, is an apparent immunity to both pressure and criticism.

"Scorers kind of have a fighter-pilot mentality. We're a different breed," Bryant said. "But there are different positions. We scored in a myriad of ways. We all went about it differently in different situations. It's fun to see."

Notes: Stern said the scheduling that allowed him to see Bryant reach 30,000 was pure coincidence. Stern was making a regularly scheduled visit with first-year Hornets owner Tom Benson, who is also the owner of the NFL's Saints, to see how Benson's plans for the NBA franchise were taking shape. Stern visited Saints headquarters, where new construction has begun on additions that will also accommodate Hornets offices and practice courts. Stern said he was looking forward to congratulating Bryant. "As a talent, a competitor, I think that he is up there on the pedestal with Michael Jordan. He is one of the greatest," Stern said. ... Stern also discussed the possibility of a team name change, something Benson has said he wants since buying the club last spring. Stern says the club has not yet applied for a name change but that the league would likely accept whatever name the Hornets want and expedite the transition.

NHL talks resume with owners, players meeting

NEW YORK (AP) ? The only early details that emerged from the latest round of negotiations aimed at ending the NHL lockout were the names of those in attendance and that the sides took a break for dinner nearly six hours after they started talking Tuesday.

A group of six owners and 18 NHL players ? many more than were originally expected ? gathered at a Manhattan hotel and tried to find some common ground as the search for a deal that would save the hockey season continued. NHL Commissioner Gary Bettman and union executive director Donald Fehr were at the hotel but stayed outside the meeting room.

Not much has worked up until Tuesday, the 80th day of the lockout, so the sides agreed to a different format to see if that would shake things up.

"I'm hoping we get to where we need to be," Bettman said before talks got under way Tuesday afternoon.

The dialogue continued, sometimes in smaller groups, throughout the day until the sides separated for a dinner break. The owners left while the players stayed to have a meal inside the hotel. The owners were expected to return to the hotel later Tuesday night, but it wasn't determined before they left whether they would reconvene with the union again.

Also, there was no assurance from either side that any of the participants would make any public statements Tuesday night.

As more and more days pass by, the possibility that the entire hockey season will be lost grows. A lockout forced the cancellation of the 2004-05 season in February, and the belief is that the NHL won't wait that long this time to call off this already-delayed and shortened campaign.

All games through Dec. 14, along with the New Year's Dat Winter Classic and the All-Star game have been wiped off the schedule.

The NHL board of governors will meet in New York on Wednesday, likely to discuss Tuesday's developments and perhaps where to go from here if a deal isn't reached soon. More game cancellations could be announced then, and an internal deadline for eliminating the season could also be established.

Originally the thought was no one other than owners and players would be in attendance for Tuesday's meeting, but each side had staff present, as well. The six selected owners were Ron Burkle (Pittsburgh Penguins), Mark Chipman (Winnipeg Jets), Murray Edwards (Calgary Flames), Jeremy Jacobs (Boston Bruins), Larry Tanenbaum (Toronto Maple Leafs) and Jeff Vinik (Tampa Bay Lightning).

Jacobs, considered one of the hard-line owners, and Edwards are the only members of the group of six to have taken part in previous negotiations.

The NHL had no objection for more than six players to take part, so Sidney Crosby, Jonathan Toews, Shane Doan, Brad Richards, Martin St. Louis, Ryan Miller, Craig Adams, David Backes, Michael Cammalleri, B.J. Crombeen, Mathieu Darche, Ron Hainsey, Shawn Horcoff, Jamal Mayers, Manny Malhotra, Andy McDonald, George Parros and Kevin Westgarth took part in negotiations.

(AP) ? Republicans have to stop using "political math" and say how much they are willing to raise tax rates on the wealthiest 2 percent of Americans and then specify the spending cuts they want, Treasury Secretary Tim Geithner said in an interview that aired Sunday.

Just four weeks from the proverbial "fiscal cliff," House Speaker John Boehner countered that Republicans have a plan for providing as much as $800 billion in new government revenue over the next decade and would consider the elimination of tax deductions on high-income earners. But when pressed on "Fox News Sunday" for precise details, the Ohio Republican declined to say.

There are "a lot of options in terms of how to get there," Boehner said.

Both Boehner's and Geithner's latest remarks indicate it could be some time before serious negotiations begin between the White House and Republicans on how to avert economic calamity expected in less than a month when President George W. Bush-era tax cuts expire and automatic, across-the-board spending cuts kick in.

Last week, the White House delivered to Capitol Hill its opening plan: $1.6 trillion in higher taxes over a decade, hundreds of billions of dollars in new spending, a possible extension of the temporary Social Security payroll tax cut and enhancing the president's power to raise the national debt limit.

In exchange, the president would back $600 billion in spending cuts, including $350 billion from Medicare and other health programs. But he also wants $200 billion in new spending for jobless benefits, public works projects and aid for struggling homeowners. His proposal for raising the ceiling on government borrowing would make it virtually impossible for Congress to block him.

Republicans said they responded in closed-door meetings with laughter and disbelief.

"I was just flabbergasted," Boehner said. "I looked at him (Geithner) and I said, 'You can't be serious.'" Boehner described negotiations as going "nowhere, period," and said "there's clearly a chance" the nation will go over the cliff.

Geithner, the administration's point man for negotiations, was slightly more optimistic while saying the ball was in Boehner's court. But the treasury secretary also said he didn't expect a counteroffer right away, as Republicans work to sort out tensions within the party in the wake of bruising national elections that left Democrats in charge of the White House and the Senate.

Boehner acknowledged in his interview, aired Sunday, that he wasn't happy with public remarks by Republican Rep. Tom Cole of Oklahoma, who said he was ready to go along with Obama's plan to renew expiring income tax cuts for the majority of Americans and negotiate the rates on top earners later.

"They're trying to figure out where they go next," Geithner said of Republicans, "and we might need to give them a little time to figure out where they go next."

He called the back-and-forth "normal political theater," saying all that's blocking a timely deal is the GOP's reluctance to accept higher tax rates on the wealthy.

"It's welcome that they're recognizing that revenues are going to have to go up. But they haven't told us anything about how far rates should go up ... (and) who should pay higher taxes," Geithner said.

House Democratic Leader Nancy Pelosi said Sunday that she will try to force a vote on the Senate-passed bill favored by Democrats to avert a fiscal cliff. But she was unlikely to line up enough Republicans to succeed.

Obama's political team ramped up its efforts, blasting out an email Sunday night urging supporters to pressure Congress to extend tax cuts that would add up to about $2,000 for a middle-class family of four.

Stephanie Cutter, who was Obama's deputy campaign manager, said in the email that the president was trying to get Congress to "do the right thing and act before the New Year, but he needs our help. We've got a good track record here: When we make our voices heard and urge Congress to take action ? whether it's about health care, student loans, Wall Street reform, or 'Don't Ask, Don't Tell' ? they listen."

Republican leaders have said they accept higher tax revenue overall, but only through what they call tax reform __ closing loopholes and limiting deductions __ and only coupled with tough measures to curb the explosive growth of Medicare, Medicaid and Social Security.

"If we gave the president $1.6 trillion of new money, what do you think he'd do with it?" asked Boehner. "He's going to spend it. It's what Washington does."

Cole didn't back down Sunday on his earlier comments that Republicans should agree to Obama's plan for continuing Bush's tax rates for middle-class America and focus the negotiations on the other issues. Doing so, he said, would make the GOP position even stronger.

"The reality is, nobody can look at this budget and think if you don't reform entitlements you can balance it. You can give the president every tax increase he's asked for, you'd still be in the hole," he said.

Geithner appeared on CBS' "Face the Nation," NBC's "Meet the Press," CNN's "State of the Union," ABC's "This Week" and "Fox News Sunday." Cole appeared on ABC "This Week."
